Not At Fault? Please Do Not Call Your Insurance Company Yet!

In a not-at-fault accident? Calling your own insurance carrier might be a mistake. Here is who you should call instead.

If you are driving in Florida and get into an accident that is 100% not your fault, you need to follow my advice closely. The police might tell you to “call your insurance company to file a claim.”

With all due respect to law enforcement, that is often the wrong move.

Call Your Insurance Agent First!

If you are not at fault, you should file the claim with the at-fault party’s insurance, not yours. If you call us and file a claim on your own policy, it puts a mark on your insurance history. Even if we subrogate and get the money back later, that claim file exists.

Instead, call my office. We will guide you. We help you figure out if you should file with Allstate or if we should help you pursue the other carrier.

Let The Carriers Fight It Out

Sometimes the other driver lies and says it was your fault. In that case, we do get involved. We will look at the photos and argue your case to determine if it’s 50/50 liability or 100% them.

But start by calling your agent, not the 1-800 number. It saves you headaches down the road.
