Florida is known as a “No-Fault” state, but that term causes a lot of confusion. I often hear people ask, “Does Florida have no car insurance?” or “Does it mean no one is responsible for an accident?”.
It Is About Injuries, Not Metal
When we say “No-Fault,” we are specifically talking about Personal Injury Protection (PIP) coverage. It means that if you are injured in a collision, you will always claim for your injury from your own insurance company, regardless of who caused the accident.
It does not mean you can crash into someone and walk away without consequence. But for your medical bills and injuries, the system is designed so you don’t have to wait for insurance companies to fight over liability to get treated.
You go to your own carrier first. It simplifies the medical side of things, even if the name “No-Fault” sounds a bit misleading.
